Roper and respectfully shown to the Court that he resides in San Saba County, Texas; That R.M. Hanna is dead; That he died on or about the 16th day of December A.D. 1916 in San Saba County, Texas; That said deceased at the time of his death was a reeident of the County of San Saba, in the State of Texas; That his principal eatate was and is located in San Saba County, in the State of Texas. 2. That at the time of his death the said R.M. Hanna was seized and poss- essed of real and personal property of the probable value of Five Thousand & NO/1OO ($5,000.00) Dollars; That he left a written will and a Codicil thereto, both duly executed and herewith filed in which original Will, Dan W. Hanna was appointed Executor and in said Codicil. W.H. Hanna was appointed executor. 3. That both of said appointees, Dan W. Hanna and W.H. Hanna, have failed and neglected to file said Will for Probate and has refused to do so for more than thirty days since the death of said Testator, but have expressed their willingness for your applicant to be appointed as Administrator with the Will annexed; That it will be necessary to have an Administrator appointed to carry out the provisions of said will; That your petitioner is not disqualified by law from qualifying as Ad- ministrator of said Estate. Hanna of Holt, in the County of San Saba and State of Texas being of sound mind and reasonable good health, and considering the uncertainty of life and the certainty of death, which is liable to occur at any time. Do therefore now make, ordain, publish and declare this my last will and Testament. First I order and direct that my Executor hereinafter named shall pay all of my Just debts and funeral expenses as soon after my Decease as conviniently may be done. 2nd. After the payment of such debts and funeral expenses I give, device and bequeathe my Estate and possessions as follows, to-wit: I give and bequeaths to my youngest daughter, Ada Elizabeth Hanna 100 acres of land being part of the Homestead and bounded and described as follows; BEGINNING at a corner heretofore established for W.H. Hanna in the North boundary line of Survey Nc. 674, Fisher & Miller, said corner being in the public Road a littic East & North from the dwelling house; THENCE to run West with said North Boundary line of Sur. 674 far enough to include 100 acres by running South on parallel with West Boundary line of said Sur. No. 674 to the South side of my farm; THENCE to run East to a corner established for the North West corner of a Survey made for F.E. Grimes and the South West corner of the Survey made for W.H. Hanna; THENCE to run North with the west B. line of the W.H. Hanna sur. to the place of beginning. Together with all the improvements on the land herein described, this includes the East part of the farm, the dwelling house etc. Next: I give grant and bequeath to my present wife, Annie Julia Hanna (Nee Carter) under an agreement in our marriage, the remaining West part of the Homestead tract, consisting of 80 or 100 acres or what ever amount it may be, described by boundaries as follows: To begin at the North West corner of the piece of land herein above described for Ada Hanna and THENCE run West with the North B. line of the aforesaid Fisher & Miller Sur. No. 674 to the N.W. corner of said Survey; THENCE to run South with the West B. line of said sur. to the Cor. of this quarter section the same being the South East Cor, of the H. Anderson Sur; THENCE run East with the South 3. line of this quarter section to the Southwest cor. of the land herein de- scribed for Ada Hanna; THENCE to run North to the place of beginning, together with all improvements thereon, this inoludes the West portion of my farm, and in case of the death of the said Annie Julia Hanna before any division of this estate is made, this portion herein described is to fall to her daughter Susie Carter my step-daughter. Next. I give grant and bequeathe to my son Dan W. Hanna and my daughter Ida M. Anderson and my step-daughter Eva Muse an equal undivided interest in and to the remainder of my land, the some bsing the South West quarter of this section NO. 674 F & M. and described by bounds as follows: BEGINNING at South West cor. of said Sur. No. 674: THENCE running East with South 3. line of said sur. to the S.W. Cor. of the F.E. Grimes sur; THENCE run North with the West 3. line of the Grimes sur. to corner of same. The same being the S.W. cor. of the W.H. Hanna Sur; THENCE to run West with South B. line of the home-stead tract to West B. line of the 674 aur; THENCE run South with said West B. line to the place of beginning, containing 160 or 200 acres or whatever it may be. My son Joseph Y Hanna & My son W.H. Hanna and my stepson F.E. Grimes having already received their portion of the land & released any claim on the remainder as per release filed herewith. I hereby order and decree that if there is any cash assets. notes, accounts, or personal property remaining after all expenses and liabilities have been settled the same shall be equally divided among all of my legal heirs. And lastly I make, constitute and appoint my son J.A. Muse of Holt, Texas to be Executor of this my Will and wishes and he is also hereby appointed to act as Guardian for my daughter Ada Hanna both for her person and property during her minority and also as my executor to make or cause to be made, good & valid titles to the diferent parcels of land herein mentioned and to do and perform any other act or thing required in the premises. Hanna of Holt, Texas, do make this my Codicil hereby confirming my last will made on the 10 day of March 1913 so far as this Codicil is consistent therewith; andI do here by give, devise and bequeath at my decease, the herein described per- sonall property to my wife, Annie J. Hanna; The buggy and the old Chestnut sorrell buggy horse, and a sufficient amount of feed to keep the horse through the winter; two pigs, all turkeys and chickens, all kitchen furniture, washing machine, one iron bedstead, one set of springs two mattresses, two quilts, two chairs and the foul house and poultry netting on the North side of the residence. I also be- queath to my wife Annie J. Hanna the use and controll of the house and promises where she now resides, until Dec. 31, 1917; also one half of the rent produced on the farm during 1917 the remaining one half of said rents or the proceeds therefrom to be applied to my indebtedness. I also give and bequeath to her daughter Susie Carter my book-case and writing desk. And I give and bequeath to my daughter Mrs. Ada Daniels one, iron bedstead folding springs center table, one sewing machine, two feather pillows, one box of quilts, one trunk of her mothers' clothes; and one water set; two portraits; one of herself and one of her father and mother; I also give and bequeath to my daughter Ida M. Anderson, her mothers' dresser two wood, Bedsteads, one mattress, two feather pillows, one large patchwork quilt and three other quilts. To my son Joe Y Hanna, I give and bequeath to my watch and gold frame eye glasses; to my son Dan W. Hanna, I give and bequeath my blacksmith and carpenter tools, and I, R.M. Hanna, name and appoint as Executor of this Codicil my son W.H. Hanna of Fort Worth, Texas; In testamony whereof I hereunto sign my name on this the 25th day of November in the year of our Lord 1916. I May Term, A.D. 1917. On this the 30th day of May, A.D. 1917, personally appeared in open court, Mrs. A.J. Hanna, who being duly sworn, deposes and says:- My name is Mrs. A.J. Hanna; I am the surviving widow of the late R.M. Hanna, Deceased; he is dead, having died December 17th, 1916; died at his home in San Saba County Texas; Mr. R.M. Hanna and I were married April 9th, 1912; we resided from that date at the home at which he died; I have continued to reside at the same place since his death; I have no other home; The paper which is offered for Probate, purporting to be the Last Will and Testament of my late husband, R.M. Hanna, deceased; was written by Mr. Hanna, the testator, wholly by himself in my presence, at our home, and is in his handwriting. This paper was written several weeks before the date it bears and before he came to San Saba and signed and aoknowledged it. The reason of the delay was, on the account of bad weather, he could not come to San Saba. No one else was present at the time he wrote it. Mr. Hanna was perfectly in his right mind at the time he wrote this Will, prior thereto and subsequently thereto, up unto the time of his death, and knew, at all times what he was doing; there was no one influenced him to write this will, so far as I know. The circumstances under which the Will was written were, about as follows: He came into the room and suggested that it was a disagreeable day out, and that he could not work and that if I would get him his Old Will he would now write his Last Will as he had been intending to do for some time. He built on a good fire and I got him the old Will, and he proceeded to write this will, putting in pretty much the entire day writing it; I read the old Will there that day and remember that it provided that the 200 acre homestead was bequeathed to his youngest daughter, Ada Hanna who was then a minor; that is the time at which the old will was vritten, which I think was written some three years prior to the date of this Will and the remainder of his land was bequeathed to his son, D.W. Hanna and his daughter, Eva Muse, the personal property was to be sold and his debts paid out of the proceeds, there was no provision made in that old Will for his daughter, Mrs. Ida Anderson and the will gave it as a reason, for her disinheritance,, the contents of a certain letter, which was pinned to the old Will, purporting to have been written by her to her father, (perhaps it was addreseed to her father and mother both). When he came to providing for his children under this will, now offered for Probate, he suggested Ihat he did not intend to make any provisions for Mrs. Anderson in this Will, but I Suggested to him that Mrs. Anderson was his own child, as much so as any others of his children and that she was in fact more to him than his Step-children, and that it did not seem right that he should disinherit her; and that he ought to make the same provision for her that he was making for his other children. Upon my suggestion he then provlded for her as this Will shows. After the will was written he remarked that now he had no further use for the old Will and threw the old Will and the letter from Ida, which had been pinned to it into the fire, and the same was destroyed. He gave me this Will and told me to take care of it, which I did. This Will offered for Probate was kept in my exclusive possession, in my trunk at homeuntil some five to six weeks prior to Mr. Hanna's death, when it was put in an envelope and deposited in the Richland Springs Bank for safe keeping there it remained until I brought it hereto be probated, prior to the last term of this Court, and it ham been in no manner changed, since it was originally written. Prior to the time that Mr. Hanna and I married he agreed after we were married that he would deed or Will to me one-half of his Home-stead place, the half that in- cluded what is known as "The Rent Place" with the residence and improvements there to connected, and this new Will is in compliance with that promise. At the time that we were married Mr. Hanna was about 65 years of age, and had been married theretofore, twice; and at the time of our said marriage, my age was 52. I was a widow had a minor daughter living with me. At the time of Mr. Hanna's death he did not own personal property sufficient to pay the indebtedness against the estate. MRS. A.J. Roper, who being duly sworn, deposes and says:- My name is J.M. Roper; I have been living a neighbor to the late Mr. R.M. Hanna for about 20 years or more: during this time Mr. Hanna as Notary Public in our community has done considerable Notary work for me from time to time and I have seen him write in the course of his official business from time to time and has rendered me familiar with his hand writing; The Will offered for Probate and now shown me, looks like Mr. Hanna's hand writing; from the best of my knowledge this Will was written by Mr. Hanna; from my familiarity with R.M. Hanna's hand writing I believe that I can come nearer swearing positively to his hand writing than to any one outside of my immediate family; I believe from my knowledge of his hand writing that the Will now shown me is in R.M.
